Bail application draft

A bail application asks the court to release a person from custody, or to protect them from arrest, on conditions. The usual kinds are regular bail after arrest, anticipatory bail before arrest, interim bail for a short period, and default or statutory bail when the law allows it.

What the draft contains

casemate's bail layout has the court heading, the FIR or crime number, the parties, the facts, the grounds, and the prayer for bail. Grounds that usually belong there include the applicant's ties to the place, the state of the investigation, the time already spent in custody, and any condition the applicant will accept. If a fact is not in the papers you uploaded, the draft leaves a blank instead of guessing it.

Before you file

Check the court, the sections, and whether the offence is one in which that kind of bail can be sought. The section and the Act depend on the date of the offence and the law that applies to it. The advocate decides the forum: the magistrate, the sessions court, or the High Court.
